AVEVA Acceptable Use Policy

 

WHO AVEVA ARE AND HOW TO CONTACT AVEVA  

 

The Acceptable Use Policy ("AUP") describes acceptable and prohibited uses of the AVEVA Site and AVEVA Services operated by AVEVA Solutions Limited (”AVEVA”) or its affiliates or third party service providers. AVEVA is a limited liability company registered in England and Wales under company number 00803680 and has its registered office at High Cross, Madingley Road, Cambridge, CB3 0HB.

 

The examples described in this AUP are not exhaustive.

 

By using the AVEVA Site and AVEVA Services, you confirm that you accept the terms of this AUP and that you agree to comply with them. If you do not agree to these terms, you must not use the AVEVA Site or AVEVA Services.

 

DEFINITION OF KEY TERMS

 

         AVEVA Services: means the online services (including software applications as a services) that AVEVA makes available on or through the AVEVA Site.

 

         AVEVA Site: means the web site at https://connect.aveva.com or such replacement or updated web address.

 

         Client: means the entity with whom we have entered into a contract to provide the AVEVA Services (such client is likely to be your employer or the party that instructed you to use the AVEVA Services for their internal business purposes).

 

INTRODUCTION

 

The AVEVA Site and AVEVA Services are provided by AVEVA to its clients on a business to business basis.

 

In relation to your use and our provision of the AVEVA Services, this is governed by our agreement with our Client which sets out the terms on which we provide the AVEVA Services and our rights, obligations and protections in relation to the AVEVA Services. Our liability in relation to the AVEVA Services is subject to the terms of this agreement with our Client. You should enquire with the Client (likely to be your employer or the party that instructed you to use the AVEVA Services) if you have any questions in relation to the AVEVA Services or our agreement with Client.

 

In using the AVEVA Services and accessing the AVEVA Site on behalf of the Client, you must comply with the terms of the agreement we entered into with the Client, including this AUP.

AVEVA, its affiliates or its licensors own all right, title, and interest in and to the AVEVA Site and AVEVA Services, and all related technology and Intellectual Property Rights. You are permitted to access and use the AVEVA Site and AVEVA Services solely in accordance with the terms of the agreement we have entered into with the Client.

 

The AVEVA Site may include information and materials uploaded by other users, including to bulletin boards and chat rooms. This information and these materials have not been verified or approved by AVEVA. The views expressed by other users on the AVEVA Site do not represent the AVEVA Site views or values. If you wish to complain about information and materials uploaded by other users please contact AVEVA.

 

Whenever you make use of a feature that allows you to upload content to the AVEVA Site, or to make contact with other users of the AVEVA Site, you must comply with the content standards set out in this AUP.

 

AVEVA has the right to disclose your identity to its licensors and third party providers and any third party who is claiming that any content posted or uploaded by you to the AVEVA Site constitutes a violation of their intellectual property rights, or of their right to privacy.

 

AVEVA has the right to remove any posting you make on the AVEVA Site if, in AVEVA’s opinion, your post does not comply with the content standards set out in this AUP.

 

YOUR USER CREDENTIALS

 

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of AVEVA’s security procedures, you must treat such information as confidential. You must not disclose it to any third party.

 

AVEVA has the right to disable any user identification code or password, whether chosen by you or allocated by AVEVA, at any time, if in AVEVA’s reasonable opinion you have failed to comply with any of the provisions of this AUP or our agreement with the Client.

 

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify AVEVA.

 

No Illegal, Harmful, or Offensive Use or Content

 

You must not use, or encourage, promote, facilitate or instruct others to use, the AVEVA Services or AVEVA Site for any illegal, harmful, fraudulent, infringing or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing or offensive. Prohibited activities or content, include but are not limited to:

 

·         Illegal, Harmful or Fraudulent Activities. Any activities that are illegal, that violate the rights of others, or that may be harmful to others, AVEVA’s operations or reputation, including disseminating, promoting or facilitating any form of pornography, offering or disseminating fraudulent goods, services, schemes, or promotions, make-money-fast schemes, ponzi and pyramid schemes, phishing, or pharming.

 

·         Infringing Content. Content that infringes or misappropriates the intellectual property or proprietary rights of others.

 

·         Offensive Content. Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes any form of pornography, relates to bestiality, or depicts non-consensual sex acts.

 

·         Harmful Content. Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.

 

 

 

 

 

No Security Violations

 

You must not use the AVEVA Services or the AVEVA Site to violate the security or integrity of any network, computer or communications system, software application, or network or computing device of AVEVA, its affiliates or suppliers or any third party (each, a “System”). Prohibited activities include but are not limited to:

 

·         Unauthorised Access. Accessing or using any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to breach any security or authentication measures used by a System.

 

·         Interception. Monitoring of data or traffic on a System without permission.

 

·         Falsification of Origin. Forging TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route. The legitimate use of aliases and anonymous remailers is not prohibited by this provision.

 

No Network Abuse

 

You may not make network connections to any users, hosts, or networks unless you have permission to communicate with them. Prohibited activities include:

 

·         Monitoring or Crawling. Monitoring or crawling of a System that impairs or disrupts the System being monitored or crawled.

 

·         Denial of Service (DoS). Inundating a target with communications requests so the target either cannot respond to legitimate traffic or responds so slowly that it becomes ineffective.

 

·         Intentional Interference. Interfering with the proper functioning of any System, including any deliberate attempt to overload a system by mail bombing, news bombing, broadcast attacks, or flooding techniques.

 

·         Operation of Certain Network Services. Operating network services like open proxies, open mail relays, or open recursive domain name servers.

 

·         Avoiding System Restrictions. Using manual or electronic means to avoid any use limitations placed on a System, such as access and storage restrictions.

 

No E-Mail or Other Message Abuse

 

In using or accessing the AVEVA Services or AVEVA Site you must not distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations (like ‘spam’), including commercial advertising and informational announcements. You will not alter or obscure mail headers or assume a sender’s identity without the sender’s explicit permission. You will not collect replies to messages sent from another internet service provider if those messages violate the AUP or the acceptable use policy of that provider.

 

AVEVA’S Monitoring and Enforcement

 

AVEVA reserves the right, but does not assume the obligation, to investigate any violation of the AUP or misuse of the AVEVA Services or the AVEVA Site. AVEVA may:

 

·         investigate violations of the AUP or misuse of the AVEVA Connect Services or the AVEVA Site; or

 

·         remove, disable access to, or modify any content or resource that violates the AUP or any other agreement AVEVA has with you for use of the AVEVA Connect Services or the AVEVA Site.

 

AVEVA may report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. AVEVA’s reporting may include disclosing appropriate customer information. AVEVA may also co-operate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of the AUP.

 

UPDATING THIS AUP

 

AVEVA may modify this AUP at any time by posting a revised version on the AVEVA Site. By using the AVEVA Services or accessing the AVEVA Site, you agree to the latest version of the AUP, which can be obtained or viewed at https://connect.aveva.com/AcceptableUsePolicy.html. If you violate the AUP or authorise or help others to do so, AVEVA may suspend or terminate your use of the AVEVA Services and the AVEVA Site and you may incur liability on behalf of the Client.

 

Reporting of Violations of the AUP

 

If you become aware of any violation of the AUP, you will immediately notify us and provide us with assistance, as requested, to stop or remedy the violation. To report any violation of the AUP, please contact connect.operations@aveva.com.
